3. Quotations and Pricing

3.1 Quotation Validity

All quotations provided by Facade & Build Ltd are valid for 30 days from the date of issue unless otherwise stated in writing. After 30 days, prices may be subject to revision due to changes in material costs, labour rates, or market conditions.

3.2 Pricing Terms

Unless otherwise agreed in writing, all quotations are:

• Exclusive of VAT at the applicable rate
• Based on information provided by the client at the time of quotation
• Subject to revision if site conditions differ from initial assessment
• Estimates only and not guaranteed final costs

3.3 Variation of Costs

If unforeseen circumstances, changes in specifications, or site conditions alter the scope of work, Facade & Build Ltd reserves the right to adjust pricing accordingly. Any variations will be communicated to the client in writing before proceeding with additional work.

4. Payment Terms

4.1 Payment Method

Payment is accepted via:

• Bank transfer (BACS)
• Cheque (if pre-arranged)
• Debit or credit card (if applicable)

4.2 Payment Schedule

Standard payment terms are Net 30 (payment due 30 days from invoice date). For large projects, we may require:

• A deposit (typically 20-30%) upon order confirmation
• Progress payments at agreed milestones
• Final payment upon project completion

4.3 Late Payment

Payment must be made by the due date. If payment is not received by the due date, we may:

• Suspend or halt work on the project
• Charge interest on overdue invoices at 8% per annum plus the Bank of England base rate (in accordance with the Late Payment of Commercial Debts (Interest) Act 1998)
• Recover reasonable debt recovery costs
• Terminate the contract if payment is 14 days overdue

5. Liability and Limitations

5.1 Website Use

This website is provided on an "as is" basis. While we strive to keep information accurate and up-to-date, we do not warrant that:

• The website will be error-free or uninterrupted
• Information is complete or accurate

5.2 Limitation of Liability

Upon full payment, clients own the physical works installed (e.g., fitted joinery, plumbing systems). However, design concepts and methodology remain our intellectual property.

7. Warranties and Guarantees

7.1 Quality of Work

We warranty that all work will be carried out professionally, in accordance with applicable building regulations, industry standards, and the specifications agreed in the project agreement.

7.2 Warranty Period

Unless otherwise stated in the project agreement, we provide a 12-month warranty on workmanship from the date of completion. This covers defects in installation caused by our workmanship but excludes:

• Damage caused by misuse, accident, or neglect
• Wear and tear from normal use
• Defects in materials supplied by others
• Maintenance issues

7.3 Material Warranties

Warranties on materials and products supplied are those provided by the manufacturers. Facade & Build Ltd is not responsible for manufacturer defects. We will facilitate warranty claims with manufacturers where applicable.

8. Health & Safety

All work is carried out in accordance with the Health and Safety at Work etc. Act 1974 and the Construction (Design and Management) Regulations 2015. Clients must:

• Provide safe access to the work site
• Inform us of any hazards on the premises
• Comply with our site safety requirements
• Ensure adequate insurance is in place

9. Cancellation and Termination

9.1 Cancellation by Client

If you cancel a project after a quotation has been accepted:

• Cancellation within 7 days of order: Full refund of any deposit
• Cancellation after 7 days: Costs incurred (materials, labour, administration) will be charged
• Cancellation after work has commenced: Full payment for work completed plus reasonable costs incurred

9.2 Termination by Facade & Build Ltd

We may terminate the contract if:

• Payment is 14 days overdue
• You breach material terms of this agreement
• You provide unsafe or inaccessible working conditions
• Unforeseen circumstances make completion impossible

10. Site Access and Conditions

You are responsible for ensuring:

• Safe and clear access to the work site
• Adequate facilities (electricity, water, parking)
• The building is structurally sound and free from hazards
• All necessary consents and approvals are in place (planning, building control, landlord consent)

Any delays caused by lack of access or unsafe conditions may result in additional charges and adjusted timelines.

11. Building Regulations and Compliance

While Facade & Build Ltd carries out work in accordance with building regulations, the ultimate responsibility for obtaining Building Control approval and relevant consents rests with the property owner. We recommend:

• Engaging Building Control early in the project
• Ensuring all necessary planning permissions are obtained
• Obtaining certification for gas, electrical, and other regulated work

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the English courts.

13. Dispute Resolution

13.1 Informal Resolution

13.2 Formal Resolution

If informal resolution fails, either party may pursue the dispute through:

• Mediation: A neutral third-party mediator may help reach agreement
• Arbitration or Legal Action: As a final resort, disputes may be referred to the courts of England and Wales

14. General Provisions

14.1 Entire Agreement

These Terms, along with any signed project agreement, quotation, and invoices, constitute the entire agreement between you and Facade & Build Ltd regarding the services provided.

14.2 Amendment

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.

14.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14.4 Waiver

Our failure to enforce any term does not constitute a waiver of that term or any other term.

14.5 Third Parties

These Terms are between you and Facade & Build Ltd. No third parties have rights to enforce these Terms.

15. Consumer Rights

For services provided to consumers (as defined under the Consumer Rights Act 2015), please note that certain statutory protections apply. Services must be provided with reasonable care and skill, and within a reasonable timeframe. You have statutory rights regarding faulty or incomplete services.
